1 LICENSE

2 BACKUP - TRANSFER - PERMITTED USE

You are NOT allowed:

A) To sell or transfer the product.

B) To reverse engineer the Software or in any manner circumvent the protection lock or merge it with any other Software.

C) To use the program in a shared environment without permission of SP Consult.

D) To redistribute or share TraderMetrics data in any way, unless permissioned to do so within an extended license agreement.

The product is confidential and contains copyrighted material, it may not be disclosed to anyone in whole or in parts.

ANY BREACH OF THIS LICENSE WILL RESULT IN PROSECUTION TO THE FULL EXTENT OF THE LAW, IN THE U.S.A. AND IN ANY COUNTRY WHERE THE BREACH WAS COMMITTED.

3 LIMITED WARRANTY

It should not be assumed, or is any representation made, that the use of the product will make you money.

THE PROGRAM PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE ENTIRE AND TOTAL RISK AS TO THE RESULTS AND PERFORMANCE IS ASSUMED BY YOU. SHOULD THE PROGRAM PROVE DEFECTIVE YOU (and not SP Consult or SimCorp A/S) ASSUME THE TOTAL COST OF ALL REPAIR AND SERVICING AND CORRECTION FURTHER, SP CONSULT DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS WHATEVER, REGARDING THE USE OF, OR THE RESULTS OF THE USE OF THE PROGRAM IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CORRECTNESS OR OTHERWISE NOW OR IN THE FUTURE, AND YOU RELY ON THE PROGRAM AND THE RESULTS SOLELY AT YOUR OWN RISK. THIS LIMITATION INCLUDES BUT IS NOT LIMITED TO USE OF THE PROGRAM AND THE RESULTS OF THE PROGRAM FOR INVESTMENT AND/OR SPECULATIVE PURPOSES.

THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE THAT IS MADE BY SP CONSULT ON THIS PRODUCT.

IMPORTANT

SP CONSULT, SIMCORP A/S NOR ANYONE CONNECTED WITH THIS PRODUCT OR THE CREATION OF SALE OR DELIVERY THEREOF SHALL BE LIABLE FOR ANY DIRECT OR INDIRECT CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF THE USE, THE RESULTS OF THE USE OR THE INABILITY TO USE SUCH PROGRAM

You also acknowledge by accepting this agreement that SimCorp A/S has no responsibility for the sale, distribution or support of this program and that all sales enquiries are to be directed to SP Consult.

SP Consult is under no obligation to provide Virtual Market Sessions. These sessions will be provided at the discretion of SP Consult.

SP Consult will under no circumstances be liable for any charges in conjunction with the running of the TraderMetrics or TraderMetrics Network Server levied by software companies, Internet Service Providers or other parties.

4 NO ADVICE

By accepting this agreement, you fully acknowledge that the TraderMetrics software is intended only to be a Computational aid, and it is NOT intended to supply any kind of investment, speculation or legal advice. You acknowledge that you are responsible now and in the future for any action you make in any markets, furthermore if you need such advice you will consult with professional advisors and you do not rely on the TraderMetrics software to supply or substitute such professional advice.

Trading contains substantial risk and is not for everyone. You could potentially lose all, or more than the initial investment. Risk capital is money that can be lost without jeopardizing ones financial security or life style. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. You are solely responsible for the trading decisions you make. NO express or implied warranties are made.
